TERMS OF SERVICE

1. Acceptance of Terms

By downloading, installing, or using the Stepstakes app or visiting playstepstakes.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. The Service

Stepstakes is a free weekly walking sweepstakes. Participants earn entries by meeting a personalized daily step target. Entries are used to select winners in a weekly random drawing. No purchase is necessary to participate.

3. Eligibility

You must be at least 18 years old and a legal resident of the United States (excluding Florida and New York) to participate. By creating an account, you represent and warrant that you meet these requirements.

4. Account

You are responsible for maintaining the security of your account. One account per person. Creating multiple accounts to increase your chances of winning is prohibited and will result in disqualification and account termination.

5. HealthKit Permission

The service requires access to Apple HealthKit step count data. You may revoke this permission at any time, but doing so will prevent the service from crediting entries. If no step data is received for 7 consecutive days, your entries and emails will be paused until reconnected.

6. Fair Play

Participants must not tamper with, manipulate, or falsify step data. Stepstakes reserves the right to investigate and disqualify any participant suspected of fraudulent activity, without prior notice.

7. Prizes

Prizes are described in the app and daily email at the start of each contest week. Winners have 14 days to claim. Unclaimed prizes are forfeited; no alternate winners are selected. Prizes with an aggregate value of $600 or more in a calendar year are subject to IRS reporting requirements. Winners are solely responsible for all applicable taxes.

8. Intellectual Property

The Stepstakes name, logo, app, website, and all related content are the property of Around The Hoop Holdings, LLC You may not copy, modify, distribute, or create derivative works based on any part of the service without prior written consent.

9. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time from the app settings.

10. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. STEPSTAKES INC. IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE VALUE OF ANY PRIZE WON BY YOU IN THE PRECEDING 12 MONTHS, OR $100, WHICHEVER IS GREATER.

11. Dispute Resolution

Any dispute arising from or relating to these Terms or the service shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts located in the State of Delaware. These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions.

YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING FROM OR RELATING TO THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE, OR BE FOREVER BARRED.

12. Changes

We may update these terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of the service after changes constitutes acceptance of the new terms.
